Exotic Island And Ski Holidays ("Agency") serves as a platform connecting travelers with a diverse array of holiday packages and destinations offered by our network of wholesalers, owners, and tour operators ("Suppliers"). The Agency does not claim ownership or control over the copyright of images and content displayed on our website, which are provided by Suppliers who market and sell their products through our service.

Supplier Content Authorization

Suppliers are responsible for uploading their content, including images, to the Agency's platform. By doing so, Suppliers affirm that they possess the legal right or have obtained appropriate licensing to use and distribute these images. The Agency requires all Suppliers to warrant the accuracy, legality, and copyright compliance of their uploaded content as part of our terms of service.

Liability and Copyright Infringement Claims

The Agency disclaims liability for any errors in images or alleged copyright infringements associated with content provided by Suppliers. In the event of an alleged copyright infringement, copyright owners are advised to contact the responsible Supplier directly to address their concerns. Concurrently, copyright owners should notify the Agency of the claim via email at copyright@exoticvacations.co.za.

Upon notification, the Agency commits to promptly facilitating the removal or disabling of access to the disputed content from our platform, pending resolution. The Agency will then await written confirmation from the Supplier that the copyright dispute has been resolved. This process is designed to ensure compliance with applicable copyright laws while respecting the rights of copyright owners.

Cooperation and Resolution Process

The Agency is committed to cooperating with all parties in resolving copyright disputes efficiently and fairly. We encourage copyright owners and Suppliers to communicate directly to facilitate a quick resolution to any issues that arise.

Compliance with the Digital Millennium Copyright Act (DMCA)

Pursuant to the provisions of the Digital Millennium Copyright Act, 17 U.S.C. §512 (the "DMCA"), Exotic Island And Ski Holidays has adopted a policy of responding to notices of alleged copyright infringement that comply with the DMCA and other applicable intellectual property laws. The Agency facilitates a designated agent to receive and act on copyright infringement notices. In cases of alleged infringement, the Agency adheres to the process outlined in the DMCA, including the prompt removal or disabling of access to material claimed to be the subject of infringing activity, followed by a notification to the implicated Supplier. The Agency also respects the principles of fair use as established under U.S. copyright law, recognizing the balance between copyright protection and the promotion of creativity, innovation, and free expression. Suppliers and copyright owners are encouraged to consider the implications of fair use doctrine where applicable before submitting copyright infringement claims.

Adherence to South African Copyright Law

In compliance with the Copyright Act No. 98 of 1978 of South Africa, Exotic Island And Ski Holidays respects and adheres to the copyright protection and enforcement mechanisms established under South African law. This includes recognizing the exclusive rights of copyright owners as stipulated by the Act, such as the right to authorize or prohibit the reproduction and distribution of their works. The Agency commits to facilitating the resolution of copyright disputes in accordance with the principles of South African copyright law, ensuring that any actions taken in response to alleged infringements are conducted with due regard for the legal rights of all parties involved.
